What Are the Requirements for Annulment in Arizona?

To obtain an annulment, you must demonstrate specific legal grounds showing that the marriage was invalid at the time of the ceremony. Because the courts generally presume a marriage is valid, having a well-documented case is essential to overturning that presumption.

First, you or your spouse must meet the state's residency criteria. Arizona law requires that at least one of the parties must have been a resident of Arizona (or stationed in Arizona as a member of the armed forces) for at least 90 days prior to filing the petition. Then, to qualify for an annulment, your marriage must fall into one of two categories: void or voidable.
