How Does Interstate Jurisdiction Affect Child Custody In Arizona?
When parents live in different states, courts must first determine whether they have jurisdiction under the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA). In most cases, the child’s home state (where the child has lived for at least six consecutive months) has the authority to issue or modify custody orders.
Issues involving interstate jurisdiction can arise when a parent moves with a child, an out-of-state custody order exists, or a child is wrongfully removed or retained. Our attorneys can communicate with courts in other states when required and pursue the enforcement or modification of custody orders in compliance with state law.
