Is Arizona a No-Fault Divorce State?

Arizona is primarily a no-fault divorce state, meaning couples don’t have to prove fault (such as infidelity or abuse) to get a divorce. Instead, either spouse may file for divorce due to “irreconcilable differences,” which refers to an irretrievable breakdown in the marriage that cannot be resolved.

What Is the Difference Between a Contested & Uncontested Divorce?

The primary difference between contested and uncontested divorces is whether the couple agrees on divorce-related issues. A traditional contested divorce is required for couples who disagree on one or more key issues, such as child custody, property division, or spousal maintenance.

Uncontested divorces are only available to couples who agree on all aspects related to the divorce. Some potential benefits include lower legal fees, faster resolutions, reduced emotional stress, and greater privacy and control over the final outcome.

However, an uncontested divorce isn’t suitable for every couple, such as those with a history of abuse or power imbalances. We can review the unique circumstances of your case and recommend the best option for your specific needs and goals.
