What Are Parental Rights? 

In Arizona, the Parents’ Bill of Rights recognizes the parental right to make decisions about their child’s education, upbringing, healthcare, and moral or religious training (A.R.S. § 1-602). These rights apply to both parents unless limited or modified by a court order.

How Are Parental Rights Established?

Parental rights are established by birth automatically for married parents, but unmarried fathers must establish paternity through a voluntary acknowledgment or court order. Until paternity is legally established, the father may have limited rights regarding custody, parenting time, and decision-making. Do Mothers Have More Rights Than Fathers in Custody Cases?

Courts do not favor the rights of the mother over the father, or vice versa.
