Helping Spouses Navigate Post-Marital & Separation Agreements in Tempe & Maricopa County

Sometimes, during an existing marriage, one or both parties may desire a post-marital agreement. A post-marital agreement is an agreement entered into between the spouses at some point during their marriage and generally assumes that they do not already have a pre-marital agreement. (If spouses have a pre-marital agreement, it can usually be amended rather than drafting a post-marital agreement.) A post-marital agreement, sometimes called a postnuptial agreement, can address the same issues as a pre-marital agreement.

Separation agreements are different than post-marital agreements. Separation agreements are generally entered into where spouses desire to live separately and apart and wish to enter into a contract that governs the physical separation and potential divorce. These are generally enforceable unless they are found to be “unfair.”

Both of these documents require precision to stand up in court. At BDB Law, we can help you avoid the common mistakes that render these agreements unenforceable. We are also prepared to litigate disputes concerning post-marital, separation, cohabitation, and domestic partnership agreements. With over 80 years of combined experience and a Certified Family Law Specialist on our team, our family law attorneys can provide the comprehensive legal guidance necessary to draft and finalize agreements that accurately reflect your intentions and protect your interests. We offer several representation options, including pay-as-you-go consultation services, limited-scope representation, and full-service representation.

Consulting with our Phoenix post-marital and separation agreement lawyers can save you a great deal of heartache and expense in the future. We can meet with you virtually, so call (602) 878-3133 or contact us online to schedule an initial consultation today.

When Does It Make Sense to Enter a Post-Marital Agreement?

A post-marital agreement can be an effective option for married couples that have specific concerns about continuing to accrue community assets and debts but want to stay married at least for the foreseeable future. Some spouses may desire a post-marital agreement because they feel that the respective financial contributions by each spouse are not fair.

More specifically, spouses may desire such an agreement if:
