What a Prenuptial Agreement Can Cover Under Arizona Law

Arizona’s Uniform Premarital Agreement Act, codified beginning at A.R.S. Section 25-201, gives couples broad authority to define their own financial arrangement. A well-drafted agreement can address a wide range of topics.

Topics a prenuptial agreement can cover:

• Treatment of pre-marriage assets and any income or appreciation from them during the marriage
• Whether income earned during the marriage is treated as separate or community property
• Ownership and equity claims in businesses and real estate owned before the wedding
• Retirement accounts, though 401(k), 403(b), and ERISA plans require additional post-marriage documents for full beneficiary control
• Spousal maintenance, including outright waiver or agreed limitations on amount and duration
• How community debts may be incurred during the marriage
• Disposition of property at death

One nuance worth noting: Arizona is a no-fault divorce state, so the enforceability of infidelity clauses remains legally unsettled. Courts have discretion in how they handle them.

A valid prenuptial agreement also has practical upside: by resolving the major financial issues in advance, it can reduce attorney fees if a divorce ever occurs, because fewer issues remain contested.

What a prenuptial agreement cannot do:

• Predetermine child custody or legal decision-making arrangements
• Waive or set a fixed amount for child support
• Require either party to violate Arizona law
• Include terms that violate public policy

One additional note on scope: a prenuptial agreement binds only the spouses. To bind third-party creditors, the agreement must be recorded in the same manner as deeds and conveyances.

What Arizona Law Requires for a Prenuptial Agreement to Be Enforceable

For a prenuptial agreement to be valid in Arizona, it must be in writing and signed by both parties before the marriage takes place. Those are the baseline requirements. Enforceability is a separate question that courts address when one party challenges the agreement.

A court can set an agreement aside if the challenging party proves they didn’t enter it voluntarily, or that the terms were unconscionable at the time of signing and they weren’t given fair disclosure of the other party’s assets and debts, had no independent knowledge of those assets, and didn’t waive disclosure in writing. “Unconscionable” means shocking to the conscience at signing. Unfairness alone, even significant unfairness, isn’t a legal defense under Arizona law. Arizona courts have also held that failing to read the agreement before signing doesn’t excuse a party from its terms.

Public Assistance Exception
Even with a spousal maintenance waiver, a court can still award limited maintenance if the dependent spouse would otherwise qualify for public assistance under A.R.S. 25-202.

Limitation of Actions
A.R.S. 25-205 establishes a time limit for bringing actions to enforce or set aside a premarital agreement. Maintaining conduct consistent with the agreement’s terms throughout the marriage can help protect enforceability over time.

Timing
Presenting the agreement immediately before the wedding can support a voluntariness challenge. Starting the process two to three months out can help reduce that risk.

Two community property scenarios come up frequently in our practice:

Pre-Marriage Business Ownership
A business started before the wedding is separate property under Arizona law, but the community may acquire a claim to profits and appreciated value during the marriage. A prenuptial agreement can eliminate, minimize, or quantify those claims before they arise.

Pre-Marriage Real Estate
A home owned before marriage is separate property, but if community funds are used to pay the mortgage during the marriage, Arizona’s community property rules can give rise to a community lien on appreciated value. A prenuptial agreement can address how that scenario is handled.

Couples with significant international ties should consult attorneys from both countries. Many countries recognize a properly drafted U.S. prenuptial agreement, but some jurisdictions have different formal requirements.

The Prenuptial Agreement Process at BDB Law
