What Is Child Custody?

Child custody (known as “legal decision-making” and “parenting time” in Arizona law) refers to a parent’s legal authority to make important decisions about a child’s life and the schedule for physical care, with the primary focus on the child’s best interests rather than parental preference.

What Are the Different Types of Child Custody in Arizona? 

Custody may be sole (awarded to one parent) or joint (shared between both parents). If one parent is granted sole custody, the other parent may receive visitation rights as long as they do not pose a danger to the child’s safety or well-being. 

There are two primary types of child custody:

  • Physical custody (“parenting time”) determines the child’s primary residence and which parent is responsible for their daily care and supervision.
  • Legal custody (“legal decision-making”) allows parents to make important decisions about a child’s life, such as religious upbringing, healthcare, and education.
